Terms of Service

1. Who can use StackChase

You must be at least 13 years old to use the Service. If you live in the European Union or the United Kingdom, you must also be old enough to agree to the processing of your personal data without a parent's consent where you live (between 13 and 16, depending on the country). If you're under 18, a parent or guardian should review these Terms with you.

2. Your account

You're responsible for your account and everything that happens under it. Keep your password secure, give us an email address you can access, and tell us promptly at the address below if you think someone else has used your account.

Usernames are first come, first served. We may reclaim or change a username that impersonates someone, infringes a trademark, or is offensive.

3. Your content

You keep ownership of everything you add to StackChase: your photos, card details, notes, sale and trade records ("Your Content").

You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, resize, remove metadata from and display Your Content, only as needed to run and improve the Service. That includes sending photos to the service providers that identify cards and read serial and certification numbers (see our Privacy Policy), and showing your Stack to others according to the visibility setting you choose. This licence ends when you delete the content or your account, except for backups that are removed in the normal course and anything you've already made public that others have copied.

Only upload photos you took yourself or have the right to use, and don't upload anything illegal, anything that infringes someone else's rights, or photos of other people without their permission.

4. Visibility and sharing

Each Stack has a visibility setting. Public Stacks can be seen by anyone, and are listed for search engines and AI systems to index and may be used to train AI models. Unlisted Stacks can be seen by anyone who has the link or knows your username, but aren't listed anywhere by us. Private Stacks can be seen only by you and by StackChase administrators.

Once something has been public, we can't undo copies other people or services have already made.

5. Acceptable use

You agree not to:

• break the law, or use the Service to defraud anyone, including misrepresenting a card's identity, grade, condition or ownership to a buyer;
• access or attempt to access another person's account or data, or probe, scan or test the Service's security without our written permission;
• upload malware, or files that are not genuine photos of cards;
• overload the Service or the third-party services it depends on, including through automated uploads, searches or pricing requests beyond normal personal use;
• scrape the Service in bulk, or copy its pricing data into a competing product;
• harass other users or impersonate anyone;
• upload or publish sexual content or nudity, any content that sexualises minors, illegal drugs, graphic violence, weapons, or hate symbols or slurs, whether or not it appears on a card.

Every photo you upload is checked automatically before its card can be published, for whether it shows a trading card and for the kinds of content listed above. A photo the check flags is held: its card can't be published, or is hidden if it was already public, until a StackChase administrator has looked at it. Most holds are ordinary card photos the check was unsure of, and those are cleared.

We may remove content that breaks these rules and suspend or close the account that posted it. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children, as US law requires, and preserve it for that purpose. If you think we've held or removed something by mistake, email us at the address below and a person will look at it again.

6. Pricing, identification and other information

Card values, price histories, comparable sales and identifications are estimates, produced automatically from third-party data and image recognition. They can be wrong. They are for general information only and are not an appraisal, a guarantee of what a card will sell for, or financial, investment, tax or insurance advice. Check anything important yourself before you buy, sell, insure or grade a card.

7. Third-party names and services

StackChase is not affiliated with, endorsed by or sponsored by any grading company, pricing service, card manufacturer, league, team, player or game publisher, including PSA, Beckett, Card Ladder, Topps, Panini, Upper Deck, The Pokémon Company or Wizards of the Coast. Their names and marks belong to their owners and are used only to describe cards. Links to other sites, such as marketplace listings or a grader's certificate lookup, are provided for convenience; we don't control those sites.

8. The Service

We're a small, actively developed service. Features may change, and the Service may sometimes be unavailable. The Service is currently free. If we introduce paid features, we'll tell you in advance and you won't be charged without agreeing first.

Keep your own records of anything important. You can export your collection as a spreadsheet at any time from the Stack Portal.

9. Ending your account

You can stop using the Service at any time, and ask us to delete your account as described in the Privacy Policy.

We may suspend or close an account that breaks these Terms, puts other users or the Service at risk, or where the law requires it. Where it's reasonable, we'll tell you why first and give you a chance to export your data.

10. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

11. Limitation of liability

To the extent the law allows, StackChase will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or the value of any card, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.

Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

12. If you live in the UK or EU

If you use the Service as a consumer in the United Kingdom or the European Union, you keep all the rights your local consumer protection law gives you, and nothing in these Terms takes them away. Where these Terms and those laws conflict, those laws win. You can bring a claim in the courts where you live.

13. Changes to these Terms

We may update these Terms as the Service changes. If a change is significant, we'll tell you by email or in the app before it takes effect. If you keep using the Service after that, you accept the updated Terms. If you don't accept them, you can close your account.
